2. Description of Service

GearPlug is a web and mobile application that helps music producers, musicians, and audio professionals organize and manage their studio equipment. The Service includes:

Digital catalog of music production gear and equipment
AI-powered gear identification and specifications
Cloud storage for receipts, manuals, and photos
AI assistant for music production advice
Desktop companion application for plugin scanning

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the security of your password
Accept all responsibility for activity under your account
Notify us immediately of any unauthorized use

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. User Content

4.1 Your Content

You retain all rights to the content you upload to GearPlug, including gear information, photos, receipts, and notes. By uploading content, you grant us a license to:

Store and display your content within the Service
Process your content to provide Service features (e.g., AI analysis)
Back up your content for disaster recovery

4.2 Prohibited Content

You may not upload content that:

Violates any law or regulation
Infringes on intellectual property rights
Contains malware or harmful code
Is defamatory, obscene, or offensive
Violates the privacy or rights of others

5. Subscription and Payment

5.1 Free and Pro Tiers

GearPlug offers both free and paid subscription tiers. Pro features include unlimited gear additions, unlimited AI interactions, and advanced features.

5.2 Billing

Subscriptions are billed monthly or annually in advance
iOS app subscriptions are processed through Apple In-App Purchase
Web subscriptions may use alternative payment processors
Prices are subject to change with 30 days notice
Refunds are subject to Apple's or the payment processor's refund policy

5.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain Pro access until the end of your billing period, after which your account will revert to the free tier.

6. Intellectual Property

6.1 Our Rights

GearPlug, including its design, code, features, and branding, is owned by us and protected by copyright, trademark, and other intellectual property laws.

6.2 AI-Generated Content

Specifications, descriptions, and insights generated by our AI are provided for informational purposes. We strive for accuracy but make no guarantees. You are responsible for verifying critical information.

7. Privacy and Data

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy.

8. Third-Party Services

GearPlug integrates with third-party services including:

Firebase (authentication, database, storage)
Apple In-App Purchase (iOS subscription payments)
Anthropic Claude (AI features)
Affiliate vendor links

Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Merchantability, fitness for a particular purpose, or non-infringement
Uninterrupted, error-free, or secure operation
Accuracy, reliability, or completeness of content
Availability or preservation of your data

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, or consequential damages
Loss of profits, data, use, or goodwill
Service interruptions or data loss
Third-party content or actions

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

Your violation of these Terms
Your violation of any law or regulation
Your content or use of the Service
Your violation of any third-party rights

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Termination

Either party may terminate this agreement at any time. Upon termination:

Your access to the Service will cease
You may export your data within 30 days
We may delete your data after 90 days
Provisions that should survive will remain in effect

14. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GearPlug.
